The 26th Amendment to the U.S. Constitution reads: “The right of citizens of the United States, who are eighteen years of age or older, to vote shall not be denied or abridged by the United States or by any State on account of age. The Congress shall have the power to enforce this article by appropriate legislation.”
There is no expressed universal right to vote by mail, only a right to vote. If voting by mail is to be seen as synonymous with voting in-person, Congress needs to invoke Section 2 of the Amendment which allows it to enforce the amendment “by appropriate legislation.”
As to the Texas Democratic Party argument before the Fifth Circuit Court of Appeals Monday that limiting voting by mail to those 65-years or over violates the amendment because it reads that voting “shall not be denied or abridged… on account of age” ignores the fact that denying voting by a certain procedure is not the same as denying the ability to vote.

Should anyone be able to vote from their car curbside in Texas? Such is available to those who request such because they are disabled and unable to enter the voting booth. Is denying that extra service, which requires extra personnel and supervision for the time it takes to execute, to someone who can easily enter the polling place a denial or abridgement of the right to vote or, is it simply a denial of a certain process of voting?
With the Democrat position, there is no end to the arguments that each rule and regulation adopted to make voting secure, safe, and orderly would somehow abridge the right to vote whether based on age or anything else.
You are absolutely correct on all counts. The dems are trying to do anything they can to get the vote out for Biden. They know they are in trouble with their weak candidates and socialist platform. They will even resort to cheating because they know they will get a pass in the press. They have been trampling the Constitution for years. It’s time they are held accountable.
