Instead of the tense, hateful attitudes the House has
experienced, the House, while still awaiting a vote on one key
bill, jovially passed recognition resolutions with many thank
you speeches and rounds of applause. |

HB3068: Points of Order overruled and so bill will be heard.
Bill started as a zoning bill around one lake and has ballooned,
over three days, into a 25 county zoning issue. Private property
rights folk are generally opposed. House members charge that
Senate is trying to "run-over" the House. Strong words spoken to
attempt to keep the bill from being brought up for a vote by
refusing to suspend the rules. Bill is all about zoning in open
county space because the RGV has a problem with Colonias being
built with limited standards. BAD BILL. Motion failed to suspend
the rules and so after strong debate, the bill will not come up
for a vote. |

Rep.
Burnam, super-lib, keeps attempting to have a resolution read,
out of order which is not fair to others, that is a slap at the
Speaker by honoring the parliamentarians who quit during this
flap. |
|
Points
of Order on SB482 (electric utility related) continue to eat up
the clock. Point of order sustained as the defect was real. Move
to overrule the Speaker made and Speaker allowed the motion to
overrule him. |

In
allowing SB482 to go down without a vote, Rep. King made clear
points about receiving bad advice from former parliamentarians. |

Speaker fight: legal arguments
- Problem with Dem argument is that the Constitution does
specifically speak to the office of House Speaker which brings it to
the level of a constitutional officer. Secondly, the vote was to
investigate the Speaker for wrong doing, it was not a vote to vacate

David Swinford, R-Dumas, is a Craddick supporter and chairman of
the State Affairs Committee. "There has never been a speaker I
served with who hasn't used his right not to recognize someone,"
he said. |

Gattis,
a lawyer, defended the speaker's prerogative not to recognize a
member for a motion. Without that rule, Gattis said, the House
would face anarchy. "We'd basically be able to filibuster in the
Texas House," he said. "You could shut down the whole works." |

inquiries to make speeches full of commentary. Turner can handle his
own, I don't think there is any feeling on his part that he is
having to do Craddick "dirty work". Now they are back to attempting
Personal Privilege speeches. Turner moves forward with bill

Saturday: Tommy Merritt, Rino, throws a fit saying he somehow has a
matter before the House though he had not be recognized. Claims
"order & timing" governs and that the Speaker must recognize a
member to make a motion. However, the rule applies to members laying
out "propositions" which are bills, Merritt was not moving any
proposition. |

12:39pm,
Saturday: Another motion to vacate the chair attempted. Speaker Pro
Tem Turner refuses to recognize the motion.
Talton points out rules that say Speaker is the one who interprets
rules. Asks about recognizing rules of privilege. Talton says ruling
of the House is a violation of rules. Turner refuses to recognize.
2nd Rep. attempts to appeal the ruling of the chairman but no ruling
had been made so it is pointless.
Turner has to ask all members to take their seats as they cannot
behave in a civil manner. Turner moves on with business.
Hugo Chavez Dunnam rises to say that Speaker must rule on points of
order. Turner shows that because chair did not recognize the member
there was no point of order made. Dunnam thinks rule doesn't apply
because of the wording of the section heading (silly). Rule 5
Sec.24.
Dunnam remains argumentative, will not allow chairman to finish
answers.
Dunnam continues to twist what was stated in previous night.
Attempts to appeal rulings that have not been made.
Speaker Pro Tem explains that no appeal is granted.
Rep. Eiland speaks out of order, shouts at chair, cannot grasp the
rule that Speaker does not have to recognize someone or that Speaker
can deny any appeal.
Merritt attempts to appeal ruling of the chair. Again, no ruling had
been made. Merritt argues that he has every right appeal any ruling
of the chair. However, rules say that there is no appeal on

"just" been raised to the position of constitutional officer. The
Constitution does outline the election of the Speaker - all other
officers are be rule. |

said he saw two things: "Jim Dunnam is loud and obnoxious. And

power: The Democrats ran the House for over 100 years and are the
party that invested the Speaker with so much power. Now that they
are out of power they cannot stand it. As Craddick may reap what he
has sown, so will the Democrats. |

11:30am, Saturday: 3rd-World Junta begins, with
Pitts' attack on new parliamentarians with chains of parliamentary
inquiries. Junta of Pitts', Moreno, and Geren. Geren attempts to
make the case that new parliamentarians are wrongly serving. Claim
is that because their businesses do business with other
members, that they are "employees" of those members. A BIG stretch
of the rules. It is doubtful that the new parliamentarians are
"employees" of the House. They can serve without compensation and be
officers of the House without compensation. |

Partial quote: "...a unique provision of the Texas Constitution,
Article 15, Section 7, mandates that the legislature can only
provide for the trial and removal from office of any officer of
this State by enactment of a law if a mode for a state officer's
removal has not otherwise been specifically provided for in the
Texas Constitution.
"This unambiguous provision of the Texas Constitution overrides
any supposed merit to the suggestion that a process to remove an
officer of this State can be created by one house of the
legislature during a legislative session and used to remove that
officer from office.
"Because Article 15, Section 7 specifically forbids the result
that Representatives Smith, Hill and Dunnam seek to accomplish
by motion, their reliance on precedent from sources outside of
the Rules of this House, the Texas Constitution and the laws of
this state is misplaced and violates the specific substantive
provisions and procedural guarantees of the Texas Constitution."

Speaker's race, does anyone think if Hugo Dunnam were Speaker
that he would not use all rules available to maintain control? |

|
On
Hugo Chavez Dunnam's comments about Craddick's 1971 vote there
are two things to remember. First, the Speaker then was involved
in wrongdoing and the vote was to begin an investigation, not to
"vacate the chair." Second, just because Craddick voted a
certain way doesn't mean it won and became precedent. In fact,
because Dunnam and reports do not say what he result was then, I
suspect it went the other way which now bolsters Craddick's
case. |

Democrat Ruth Jones McClendon of San Antonio: "People do things
for different reasons. We're all put here to take care of the

speaker with the regular session ready to end on Monday.
She noted there's a speaker election at the beginning of every
legislative session.
McClendon said she remains a Craddick supporter. "I gave my word
at the beginning of the session. ... It's not difficult for me
at all. I'm a woman of my word." |
