New Development in City Council Open Meetings Act Story

KCBD: City & Radio Station Debate Over Open Meeting Violations (There is no debate, the council members violated the Act. It is fact.)

City of Lubbock issues ridiculous response which does not deny violating the Open Meetings Act, it denies violating it by having a quorum of council members present.

  1. Here's a summary from the TML about what the Act requires.

  2. The Council was present as a quorum and yet see the page where council meetings and required agendas are posted here.

  3. The meeting was held with a voting quorum of the Lubbock City Council and business which falls under the authority of the City Council was discussed.

  4. In the past having a quorum present has been specifically avoided. In fact, this is such a known issue that the city uses a formal system of RSVPs for each council member for all meetings that could possibly fall under the Open Meetings Act.

  5. Even if the City successfully argues that a simple public meeting notice allows them to have a quorum of council members present (a rather unique and new claim if made), they still have a specific obligation to post the meeting with a full agenda listing each item to be discussed.

  6. Now see the posting that was on the City's site elsewhere for the Town Hall Meeting here.

  7. Do you see any "agenda" mentioned or even a specific "subject" matter mentioned in the posted notice? There is none.

  8. Additionally, the notice specifically states that councilman Price and Mayor Miller would be in attendance. If other council members were to be present such should have been included in the notice. By specifically mentioning two members being present, the notice communicates that no other members would be in attendance to a reasonable person.

  9. Here is the main page of the City website where the Town Hall notice was posted.

  10. If a citizens were wanting to see if a quorum of the council was meeting, which is a de facto City Council Meeting, the posting was not made in the area labeled for this purpose. This is a problem on its own merits.

  11. Irrespective of whether or not the quorum was legal, the posting made for the meeting did not provide for the "entire agenda" for the meeting. It did not even offer a summary agenda unless you believe that the public is to infer a specific agenda from the proper noun title of the event.

  12. Who did what:

    • The City of Lubbock council members: Miller, Jones, [Price*] and DeLeon have violated the Texas Open Meetings Act.

    • I believe councilman Price should not be considered as a violator because he was hosting the meeting. [cancel this line*]

    • The last council member to arrive other than the mayor, as the mayor was an announced part of the meeting, should have left upon arrival of the mayor (who was the last to arrive.)

    • The Mayor was the only other announced attendee but should be held accountable in his role as chairman of the council. It is his responsibility to ensure that meetings are held correctly and he should have asked either Jones or DeLeon to leave the meeting. (This is very common practice with elected bodies, boards and commissions - it is not rude or otherwise exceptional.)

    • The top official of City of Lubbock who authorized the issuance of the statement of denial should be held accountable for attempting to mislead the public. The statement is cleverly worded to argue that the Open Meetings Act was not violated due to a quorum being present. While I disagree with that position, even if it were true it does not change the fact that the Open Meetings Act was violated due to no agenda being posted and the Special Meeting notice not being posted online.

  13. Mayor Miller specifically requested, at this Town Hall meeting, that the citizens of Lubbock hold him accountable. That is what we are doing.

  14. Here is the supposed special notice they claim. Note it was not on the website as required by law nor does it have an agenda. Due to the size of the City of Lubbock, having it on the wall at city hall but not online is the same as not having it at all. And even if it were posted online, where is the required full agenda?
    * Price called us liars and was not man enough to come on the show to make his point.
