In Paxton case, Texas Court of Criminal Appeals protects taxpayers from massive abuse.

Pratt on TexasWhen media liberals dislike rulings from supreme courts they often describe such as coming from “sharply divided” courts as if that somehow lessens the legitimacy of court action.

The Austin American-Statesman’s Chuck Lindell did the same last week in this sentence: “The Court of Criminal Appeals was sharply divided on the matter, with three of nine judges issuing dissenting opinions, and another judge writing an opinion that disagreed with a portion of the majority ruling.”

Sorry Chuck but six to three with one of the six differing slightly is not a “sharply divided court” but more importantly, it doesn’t change the fact that on yet another issue in the prosecution of Texas Attorney General Ken Paxton, the insider persecutors have lost.

The decision means the Court of Criminal Appeals will let stand an August opinion by the 5th Court of Appeals, “which said state law and local rules limit payments to a pre-established amount for appointed defense lawyers or prosecutors,” the Statesman explained.

Justice is supposed to be equal for everyone yet the folk behind the Paxton persecution decided that they could spend hundreds of thousands of dollars of local Collin County taxpayers’ money to go after him…

Collin County had in-place a fee schedule for court appointed attorneys but the two Houston lawyers brought in to hound Ken Paxton were being paid $300 per hour as opposed to a flat $1000 for pre-trial work.

Justice is supposed to be equal for everyone yet the folk behind the Paxton persecution decided that they could spend hundreds of thousands of dollars of local Collin County taxpayers’ money to go after him all while a local murderer’s prosecution, if having to bring in special prosecutors, would be limited to the locally adopted fee schedule.

The Court of Criminal Appeals has put a stop to this abuse of local taxpayers and closed the valve flowing hundreds of thousands to the two private-sector special prosecutors who all these years later have still not brought a legitimate case to trial.
